ACTION: Daniel Hale, a heroic whistleblower who exposed US drone killings, is being sentenced on July 13. Ask the judge to give him no jail time!
(April 1, 2021) — Yesterday, Daniel Hale pleaded guilty to the crime of letting the American people know the truth about drone warfare. We have known and admired Daniel even since he started speaking out in 2013 against drone warfare, an all-too-easy way of murdering people who are often innocent civilians. Daniel faces up to a decade in prison for just telling the truth.
Daniel was accused of giving an investigative journalist truthful information in the public interest about the secretive US drone warfare program, information that revealed gross human rights violations. It also revealed that drones were more deadly and less accurate than the US government presented publicly. In fact, nearly 90% of those killed by drone strikes were not the intended target!
In November 2013, Daniel Hale spoke at our CODEPINK Drone Summit. Knowing that speaking out could bring the wrath of the US military and judiciary against him, he was extremely nervous. But knowing that there were people in the audience whose loved ones were killed by our drones, he was determined to do what no US politicians have done: apologize.
“To the people in the audience who are victims or who are families of victims or have families who live in countries where US militarism, specifically unmanned systems are conducting kinetic strikes, I’m sorry,” he said.
For exposing these egregious murders, Daniel was charged with four counts under the Espionage Act of 1917 and one count of theft of government property. Meanwhile, NO ONE in the US government who actually committed the crimes of killing civilians with drone strikes has ever been held accountable.
Sending Daniel to prison is not what justice looks like.
Call on Judge Liam O’Grady to give Daniel no jail time at his sentencing on July 13!
THE LETTER
Dear Judge O’Grady,
We, the undersigned, are respectfully asking for leniency in the case of the defendant Daniel Hale, who pled guilty to one count of “retention and transmission of national defense information” in violation of the Espionage Act on March 31, 2021. We ask that Hale receive no prison time.
Daniel Hale is not a spy, a threat to society, or a bad faith actor. His revelations were not a threat to national security. If they were, the prosecution would be able to identify the harm caused directly from the information Hale made public.
While the courts have ruled that a defendant’s motive in a case related to the Espionage Act is irrelevant, we recognize that Hale’s motive was only to provide the American people with information about government misconduct. We believe that rather than harm our country, Hale’s revelations actually enhanced our democracy by providing critical information about what our government has been doing in our name. We also believe that Hale’s revelations help push our government to reassess its drone program in light of its violations of US and international law.
Sentencing Hale to years in prison would set a terrible example for freedom of speech and send a message that the American public does not have a right to know about government misconduct. Please consider giving Hale no prison time.

Drone Warfare Whistlerblower Daniel Hale
In response to the guilty plea that Daniel Hale entered on March 31, 2021, in the government case against him for whistleblowing, CODEPINK wants to express our total solidarity with Daniel Hale. Daniel deserves to be awarded for his courage in exposing the truth about extrajudicial assassinations by killer drones, not imprisoned.
No one in the US government, including the military and the CIA, has ever been held accountable for the horrific crimes of killing civilians in drone strikes. But Daniel Hale is being severely punished for wanting to let the American public know what was being done in their name. He was accused of giving an investigative journalist truthful information about the secretive US drone warfare program, information that revealed gross human rights violations, including the fact that drones were more deadly and less accurate than the US presented publicly. In fact, this data showed that nearly 90% of those killed by drone strikes were not the intended target!
For exposing these egregious murders, Daniel was charged with four counts under the Espionage Act of 1917 and one count of theft of government property. Facing decades in prison, on March 31, 2021, Daniel pleaded guilty to one count of “retention and transmission of national defense information” in violation of the Espionage Act. This plea could result in years in prison, but will likely be a fraction of the decades in prison time that the government originally sought. But his ordeal may still be further complicated: While Daniel pled guilty to one of the five counts, the government has yet to dismiss the remaining four counts.
We at CODEPINK have known and admired Daniel even since he started speaking out against drone killings in 2013. In November 2013, Daniel Hale spoke at our CODEPINK Drone Summit. Knowing that speaking out could bring the wrath of the US military and judiciary against him, he was very nervous. But he was determined to do what no US politicians have had the courage to do: apologize to the innocent victims of our military attacks.
“To the people in the audience who are victims or who are families of victims or have families who live in countries where US militarism, specifically unmanned systems are conducting kinetic strikes, I’m sorry,” he said. “For a short period of time during my military career as an analyst, I worked with unmanned systems and deployed to Afghanistan. And at the very least, you all deserve an apology” Hale said.
In the government’s case against Daniel, they were not able to identify a single person harmed or killed by his actions. But the drone program that Daniel was accused of exposing led to the death and maiming of thousands of civilians, including many children, who were simply “in the wrong place at the wrong time.”
From Afghanistan and Pakistan to Somalia and Yemen, the US military and CIA have used killer drones to bomb wedding parties, funerals, farmers working in their fields, or families simply sleeping in their beds at night.
Shamefully, US courts have held that a whistleblower’s motive— revealing information in the public interest to expose government misconduct—is irrelevant in an Espionage Act trial. That’s why Congress must amend the draconian and antiquated Espionage Act, since it makes it impossible for whistleblowers like Daniel Hale to get a fair trial.
Daniel Hale will be up for sentencing on July 13 in front of Judge Liam O’Grady. We are calling on the judge to not sentence him to jail time. Please join us in petitioning the judge for leniency.
